These Terms & Conditions ("Terms") govern your use of Bingo Nörd (the "Service"), a service that lets hosts create custom bingo games and lets players join and play them. The Service is provided by Dichromatic AB ("we", "us", "the Seller"). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation; if you use it as an individual, you confirm you are of legal age to enter into these Terms.
1. The Service
Bingo Nörd lets a host build a bingo game from their own list of items, publish it, and invite players with a join code. Each player creates one bingo card tied to their first name and last initial, randomly generated from the host's item list, and can mark and unmark squares. Hosts can save drafts for free; publishing a game consumes one game credit. Game credits are sold as one-time purchases (a single game credit, or bundles of 6 or 15 credits) and do not expire or renew automatically. Promotional codes may grant free credits and may be withdrawn or changed at any time.
2. Accounts
Hosts must create a free account (via Google sign-in) to create and publish games. You must keep your account credentials confidential and are responsible for all activity under your account. You must provide accurate information and keep it up to date. Players do not need an account; they join with a game code and identify themselves with a first name and last initial.
3. Payments, billing and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. All purchases are one-time; there are no subscriptions or recurring charges. Please also see our Refund Policy.
4. Licence and restrictions
We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You must not reverse engineer the Service, resell or redistribute it, or circumvent technical limits (such as the game-credit system).
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful purpose;
- engage in fraud, spam or deceptive practices;
- infringe anyone's intellectual property rights;
- interfere with the Service's security or operation, including by introducing malware, probing or scanning for vulnerabilities, or scraping the Service;
- create game content (items, game names, free-space labels) that is unlawful, hateful, harassing, defamatory or otherwise objectionable.
Anyone may report a game they find objectionable using the "Report this game" link on the game page. Reported games are evaluated by representatives of Dichromatic AB. If a game is deemed to conflict with this acceptable use policy, it will be removed from the Service and will no longer be available to the host or players. No refund is given for game credits spent on a game removed for this reason.
6. Your content
Hosts provide the content of their games (item lists, game names and free-space labels). You retain ownership of your content. You grant us a limited licence to host, store and process that content solely to provide the Service. You are responsible for your content and must have the rights to use it. If a rights holder complains about content in a game, we may remove or restrict that content, and repeated infringement may lead to suspension or termination of your account.
7. Intellectual property
We retain all ownership of the Service and its intellectual property, including the software, documentation and branding. Nothing in these Terms transfers any of that ownership to you.
8. Service level
We work to keep the Service available, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and "as available".
9. Warranties and liability
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability to you is capped at the fees you paid to us in the 12 months before the claim. Nothing in these Terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law.
10. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
11. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, refund abuse (a pattern of excessive or abusive refund requests, as described in our Refund Policy), or repeated or serious policy violations. When an account is closed, hosted games and player cards may be deleted; unused game credits are forfeited and are not refundable except as described in our Refund Policy.
12. General
Governing law and disputes
These Terms are governed by the laws of Sweden, and disputes will be resolved in the courts of Sweden, unless mandatory consumer law in your country of residence gives you other rights.
Assignment
You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control.
Changes
We may update these Terms from time to time. Continued use of the Service after a change means you accept the updated Terms.
